A bill making it illegal to film or take photos under a person's clothes has cleared a hurdle in the Georgia Senate. The Senate is considering a similar bill. The gap in state law came to lawmakers' attention last summer when a divided Court of Appeals found that a man didn't do anything illegal by filming videos up a woman's skirt while she shopped at a grocery store. Security footage showed Brandon Lee Gary aiming his phone under the woman's skirt at least four times as she shopped. The court's majority opinion described Gary's actions as "reprehensible" but found he didn't explicitly violate the state's invasion of privacy law. The woman who accused Gary attended the hearing.
Police found more than photos of women, including eight upskirt photos and a video, on the phone of a man lurking around the women's section of a Wal-Mart, according to a Jupiter police arrest report. Indiantown Rd. The guard noticed Gorman following around young girls with the camera app open on his phone, police said. At one point, security watched as Gorman moved behind an year-old wearing a green dress and took a picture from underneath her as she crouched down looking at clothing. Security called Jupiter police and when an officer arrived, he confronted Gorman about the photos. A check of Gorman's phone turned up "numerous photos of girls and several upskirt photos of women's panties," officer Christopher Morgan wrote in the arrest report.
